The following is a summary of the Terms and Conditions for this online auction for real estate located at and/or identified as 62130 Locker Plant Rd. McArthur, OH 45651 (the “Property”) Vinton County parcels 0500103000, 0500468008, and 0500470000 being 112.548 acres.

Bidder agrees to abide by these Terms and Conditions of the online auction. This auction has an undisclosed reserve price. If the highest bid meets or exceeds the reserve price, the highest bidder/s will execute the real estate purchase agreement. The real estate purchase agreement, property disclosures, and title search are available for review prior to bidding on the "documents" page of the auction website. No revisions to the real estate purchase agreement will be permitted. By bidding at this auction, Bidder agrees and confirms that Bidder understands and agrees to all of the following:

Auctioneers Brian Bauer, David McCain, and Daniel DeGarmo represent the Sellers only. All bids remain legally binding for 24 hours after the auction's conclusion.

This auction begins closing on October 12th, 2024, at 12 pm; however, bidding will remain open on this property until 5 minutes have passed without receiving a bid. This soft close ensures fairness and allows the highest bidder to win. Auctioneer reserves the right to shorten or extend this time.

You are NOT bidding by the acre. You are bidding to pay a lump sum dollar amount for the property.

A 10% Buyers Premium will be added to the winning bid to determine the purchase price of the property. The bid prices shown on the auction website DO NOT include the Buyer's Premium. Please bid accordingly.

If your bid is accepted, you are obligated to buy the Property, and you agree to pay the total purchase price, which includes your bid, the 10% buyers premium, and half of the standard fees charged by the title company to close the transaction. Buyer shall also pay for half of the cost of an Owner's Policy of Title Insurance.

The winning Bidder/s will be required to tender a non-refundable deposit by electronic transfer or other method specified by the Auctioneer within one business day after the conclusion of the auction. Failure to tender the deposit money deposit will be a default. The non-refundable deposit for Tract 1 is 3% of the final purchase price, and Tracts 2-4 will require a 10% deposit of the final purchase price.

The Property sells in its AS-IS condition. Sellers will not make any repairs or give any concessions for repairs or remedies to any defects discovered. Each Bidder and Buyer is responsible for conducting his or her own due diligence on the Property before bidding. Any desired inspections of the Property must be completed prior to bidding at Bidders expense. The sale is not contingent upon a satisfactory inspection. The real estate purchase agreement, property disclosures, and title search have been provided for all Bidders to review on the "documents" page of the auction website.

The winning Bidder is welcome to finance their purchase; however, the sale of this property is not contingent upon the winning Bidder’s ability to secure financing. Bidders seeking financing should contact a lender for pre-qualification prior to bidding.

Buyer assumes any responsibility for an appraisal gap.

If Buyer elects to remove property from CAUV, Buyer shall pay all tax recoupments. If property no longer qualifies for CAUV due to property split, Seller shall be responsible to pay any tax recoupments. This shall survive the closing.

Seller shall provide to Buyer/s, at Seller's cost, a new boundary survey for each tract sold. If the property sells as a whole, the individual tracts will not be surveyed. If any contiguous tracts are sold to the same buyer, the tracts will be surveyed as one tract.

All tract sizes are approximate. The Buyer's final purchase price will be determined on a per- acre basis by the final survey of each tract.

Closing shall occur on or before November 11th, 2024, or after county-approved surveys are completed.

The Sellers shall have the right to retain possession of the home and buildings on Tract 1 for up to 30 days after closing. 

By bidding on any of our auctions, you agree that Bauer Realty & Auctions, LLC has the right to share your name and phone number with the winning bidder only. Our bidding process is very transparent, and upon the winning bidder’s request, we may provide our bidder's list to the winning bidder at the auctioneer's discretion.

Any Bidder must be at least 18 years of age.

Bid Rigging is a Federal Felony. Auctioneer will report illegal activity by any person to the FBI for investigation and prosecution. Title 15, Section 1 of the U.S. Code makes any agreement amongst potential bidders not to bid against one another, or to otherwise dampen bidding illegal. The law provides for fines of up to $100,000,000 for a corporate offender and

$1,000,000 for an individual, plus imprisonment for up to 10 years.

In the event there are technical difficulties related to the server, software, internet, or any other online auction-related technologies, auctioneer reserves the right to extend bidding, pause the bidding, continue the bidding, or close the bidding. Neither the company providing the software nor the auctioneer shall be held responsible for a missed bid or the failure of the software to function properly for any reason.

Auction day announcements or postings take precedence over anything previously stated or printed.

Should Bidder fail to abide by these Terms and Conditions, Auctioneer and/or Sellers may commence proceedings to recover actual damages, including reasonable attorneys’ fees to enforce them.
