The following is a summary of the Terms and Conditions for this online auction for real estate located at and/or identified as 52975 Township Rd 158, West Lafayette, OH 43845 (the “Property”), Coshocton County parcel number 0180000046203, being 25 total acres.

Bidder agrees to abide by these Terms and Conditions of the online auction. This is an ABSOLUTE real estate auction. The property will sell regardless of price. The real estate purchase agreement and title search are available for review prior to bidding on the "documents" page of the auction website. No revisions to the real estate purchase agreement will be permitted. By bidding at this auction, Bidder agrees and confirms that Bidder understands and agrees to all of the following:

Auctioneer Brian Bauer and Bauer Realty & Auctions, LLC represent the Sellers only.

All bids remain legally binding for 24 hours after the auction's conclusion.

This auction begins closing on November 8^th, 2025, at 12 pm EST; however, bidding will remain open on this property until 5 minutes have passed without receiving a bid. This soft close ensures fairness and allows the highest bidder to win. Auctioneer reserves the right to shorten or extend this time.

You are NOT bidding by the acre. You are bidding to pay a lump sum dollar amount for the property.

A 10% Buyers Premium will be added to the winning bid to determine the purchase price of the property. The bid prices shown on the auction website DO NOT include the Buyer's Premium. Please bid accordingly.

If your bid is accepted, you are obligated to buy the Property, and you agree to pay the total purchase price, which includes your bid, the 10% buyers premium, and half of the standard fees charged by the title company to close the transaction. Buyer shall also pay for half of the cost of an Owner's Policy of Title Insurance.

The winning Bidder/s will be required to tender a 10% non-refundable deposit (10% of the total purchase price) by electronic transfer or other method specified by the Auctioneer within one business day after the conclusion of the auction.

The property sells in its AS-IS condition. Sellers will not make any repairs or give any concessions for repairs or remedies to any defects discovered. Each Bidder and Buyer is responsible for conducting his or her own due diligence on the Property before bidding. Any desired inspections of the Property must be completed prior to bidding at the Bidders' expense. The sale is not contingent upon a satisfactory inspection.

The winning Bidder is welcome to finance their purchase; however, the sale of this property is not contingent upon the winning Bidder’s ability to secure financing. Bidders seeking financing should contact a lender for pre-qualification prior to bidding.

Buyer assumes any responsibility for an appraisal gap.

Seller shall provide, at Seller's cost, any necessary survey work that is required for the property to transfer.

Closing shall occur on or before December 8th, 2025, or after all county approvals.

The sellers will provide a General Warranty deed to the Property.

The sellers do not own the mineral rights. The purchase of this property will not be contingent upon any mineral rights transferring to the buyer.

The winning Bidder shall be granted immediate hunting rights to the Property upon the Auctioneer's receipt of the 10% deposit.

Buyers’ purchase includes all fixtures and furnishings in cabin.

Buyers purchase includes Sure-Trac trailer and water tank.

By bidding on any of our auctions, you agree that Bauer Realty & Auctions, LLC has the right to share your name and phone number with the winning bidder only. Our bidding process is very transparent, and upon the winning bidder’s request, we may provide our bidder's list to the winning bidder at the auctioneer's discretion.

Any Bidder must be at least 18 years of age.

Only the actual buyer may register and bid. No one may bid for anyone other than themselves.

Bidders are approved to bid at the auctioneer's sole discretion.

Auctioneer reserves the right to request proof of funds or a lender's prequalification letter from any bidder.

Bid rigging is a federal felony under Title 15, Section 1 of the U.S. Code (Sherman Antitrust Act). Any agreement or understanding among potential bidders to refrain from bidding against one another, or to otherwise suppress competition, is strictly prohibited by law. Violations are subject to severe penalties, including fines of up to $100,000,000 for corporations and $1,000,000 for individuals, as well as imprisonment for up to 10 years. Auctioneer reserves the right to report any suspected illegal activity to the Federal Bureau of Investigation (FBI)or other appropriate authorities for investigation and prosecution.

In the event there are technical difficulties related to the server, software, internet or any other online auction-related technologies, auctioneer reserves the right to extend bidding, pause the bidding, continue the bidding, or close the bidding. Neither the company providing the software nor the auctioneer shall be held responsible for a missed bid or the failure of the software to function properly for any reason.

Auction announcements or postings take precedence over anything previously stated or printed.

Should Bidder fail to abide by these Terms and Conditions, Auctioneer and/or Sellers may commence proceedings to recover actual damages, including reasonable attorneys’ fees to enforce them.
