The following is a summary of the Terms and Conditions for this online auction for real estate located at and/or identified as 44264 Middle Beaver Rd. (the “Property”) being 51.986 acres. Columbiana County parcels 1200213001, 1200590010, 1200590009 and 1200590008

Bidder agrees to abide by these Terms and Conditions of the online auction. This auction has an undisclosed reserve price. If the highest bid meets or exceeds the reserve price, the highest bidder will execute the real estate purchase agreement. The real estate purchase agreement is available for review prior to bidding on the "documents" page. No revisions to the real estate purchase agreement will be permitted. By bidding at this auction, Bidder agrees and confirms that Bidder understands and agrees to all of the following:

All bids remain legally binding for 24 hours after the auction's conclusion.

Bidding will remain open on this property until 3 minutes have passed without receiving a bid. 

Your bid is a lump sum price. You are NOT bidding by the acre. 

If your bid is accepted, you are contractually obligated to buy the Property and you agree to pay the full purchase price, which includes your bid, a 10% buyers premium, and half of the fees charged by the title company to close the transaction. Buyer shall also pay for half of the cost of an Owner's Policy of Title Insurance. 

The successful Bidder at auction will be required to tender a non-refundable deposit in the amount of 10% of the final purchase price (including buyer's premium) by electronic transfer or other method specified by the Auctioneer within one business day after the conclusion of the auction. Failure to tender the earnest money deposit will be a default.  

The Property sells in its AS-IS condition. Seller will not make any repairs or give any concessions for repairs or remedies to any defects discovered. Each Bidder or Buyer is responsible for conducting his or her own due diligence on the Property before bidding. 

The sale is not contingent upon a satisfactory inspection. Any desired inspections of the Property must be completed prior to bidding. 

The sale is not contingent upon Bidder’s ability to secure financing. Bidder assumes any responsibility for an appraisal gap. 

Closing shall occur on or before September 13th, 2023.

Sellers shall have possession of the home on the property for up to 30 days from the closing date.

Tenant farmer has rights to this years planted corn crop.

All property taxes will be paid current at closing and prorated to the date of sale. 

The seller will provide a general warranty deed to the Property.

Agency Disclosure Statement must be signed by the Buyer. If Buyer makes contact with the auctioneer regarding the auction property, registers for auction, or places a bid prior to the auctioneer receiving a fully-executed Agency Disclosure Statement, no commissions will be paid.
